What laws govern the use of medical marijuana in Oklahoma? (Revised Laws 2023)

The Oklahoma medicinal Marijuana Act (OMMA), which regulates the licensing, registries, approvals, and distribution of medicinal marijuana, was approved by voters in Oklahoma State Question 788, also known as the Medical Marijuana Legalization Initiative, in 2018.

Oklahoma Medical Cannabis Laws

Caretaker Registration

Depending on whether they will be aiding an adult patient or a child patient, caretakers must submit the appropriate provider registration form. Up to two parents or legal guardians may be chosen by minor patients as authorized caretakers.

Oklahoma Medical Marijuana Card Costs

• For general patients, there is a $100 application fee.
• $20 for Medicare and Medicaid beneficiaries as well as handicapped veterans.
• Caretakers are not charged.

Extinction and Renewal

Adult patients have two years to use their initial Oklahoma Medical Marijuana Card. For patients who are under 18, the card expires when they turn 18 or after two years, whichever comes first.

Limits on Possession and Penalties.

Medical marijuana may only be legally possessed by patients or carers who have registered with OMMA. The maximum amount of items that patients and caretakers may own is

• They have 8 ounces (227 grams) of usable cannabis at home and 3 ounces (85 grams) on them.
• Cannabis concentrates weighing 1 ounce (28 grams)
• Edible things weighing 2 kilograms, or 72 ounces

General Consumption

Any use of marijuana in public is prohibited and subject to legal penalties. Therefore, the patient should only consume it in the privacy of their own home or another secure location.

Smoking 

Smoking is also only permitted in private settings, and it should never be done in front of children.

Driving

It is forbidden to use marijuana while operating a car or travelling in one. The OMMA in Oklahoma also forbids driving when intoxicated.

Workplace Discrimination

A stringent "no discrimination" policy is established under the OMMA legislation against employees based on their status in the MMJ register. An employee's use of medical marijuana cannot be the sole factor used to determine whether to recruit, terminate, or discipline them.

Oklahoma's cultivation regulations

Patients who decide to grow their own plants can have

• 6 mature plants
• 6 seedlings

Any other type of marijuana plant growing is prohibited in the state. A fine and/or incarceration are imposed for having plants or seeds on the person of a non-patient.

Is marijuana permitted in Oklahoma?

Since 2018, there has only been a partial response to the question "Is weed legal in Oklahoma?" The state legislature passed a bill allowing patients who meet certain criteria to use marijuana for medical purposes. These patients must enrol in the state's programme and claim their medical marijuana prescriptions. Numerous reports accused people of misusing medical marijuana despite the existence of clear regulations and the state's ongoing support through policy.

Qualification Requirements

Compared to other states, Oklahoma does not outline a list of medical issues that must be present for the state to designate a patient eligible. A formal recommendation letter or prescription must be provided by a qualified medical professional.

• Any persistent or incapacitating illness, condition, or therapy used to treat one that results in
• Cachexia or wasting syndrome
• Cancer
• Chronic pain, such as that caused by arthritis or migraines
• Crohn's illness
• Glaucoma
• AIDS or HIV
• Virus Hepatitis C
• (PTSD) Post-traumatic stress disorder
• Acute nausea
• Severe or ongoing muscle cramps, such those brought on by multiple sclerosis
• Seizures, especially epileptic seizures

• Documentation of Oklahoma residence
• Evidence of identity
• A full-face, colour, and sharp digital photo
• Adult patient recommendation from the doctor within 30 days of the application's submission, the form.
  If necessary, the patient must present Medicaid or VA documentation that is current (within the last six months).
